These Terms of Service ("Terms") govern your access to and use of the services provided by FischerQuant.com Corp ("FischerQuant," "we," "us," or "our"), including the FischerQuant.com website, client portal, email-delivered reports, and all related analytics services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

FischerQuant is a financial publishing and analytics service. We provide quantitative options analysis, including daily scan reports, on-demand drilldowns, settlement tracking, and related analytics delivered via email and our client portal. Our analysis is generated by proprietary quantitative models and is provided for informational and educational purposes only.

2. Not Investment Advice

The information provided through the Service does not constitute investment advice, a recommendation, or a solicitation to buy or sell any security. Our analytics identify potential trades based on quantitative models but are not tailored to any individual's financial situation, objectives, or risk tolerance. All investment decisions are made solely by the subscriber. You should consult a qualified financial advisor before making any investment decisions.

3. Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts to use the Service. By subscribing, you represent that you meet these requirements.

4. Account Registration

To access the Service, you must submit an access request and be approved. Upon approval, you will receive login credentials for the client portal. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

5. Subscription Plans and Billing

• Free Trial: New subscribers may receive a 7-day free trial of the Lite plan. No payment information is required for the trial. One trial per person.
• Paid Subscriptions: Subscriptions are billed monthly in advance through Stripe, our third-party payment processor. By subscribing, you authorize recurring charges to your selected payment method.
• Plan Changes: You may upgrade or downgrade your plan at any time through the client portal. Upgrades take effect immediately.
• Price Changes: We reserve the right to change subscription prices with 30 days' written notice. Existing subscribers will be notified by email before any price change takes effect.

6. Cancellation and Refunds

• You may cancel your subscription at any time through the client portal. Cancellation takes effect at the end of the current billing period.
• No pro-rata refunds are issued for partial billing periods.
• After cancellation, your portal access and scan archive remain available for 90 days. After that period, your account and data are permanently removed.

7. Acceptable Use

You agree not to:

• Share, redistribute, or resell any reports, analysis, or data received through the Service
• Share your login credentials with any third party
• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the proprietary models, algorithms, or source code underlying the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service

8. Intellectual Property

All content, reports, analysis, models, software, and branding associated with the Service are the exclusive property of FischerQuant.com Corp and are protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes only.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ANALYSIS WILL BE ACCURATE OR COMPLETE. PAST PERFORMANCE OF ANY ANALYSIS OR STRATEGY DOES NOT GUARANTEE FUTURE RESULTS. OPTIONS TRADING INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISCHERQUANT.COM CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES, WHETHER ARISING FROM CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless FischerQuant.com Corp, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your investment decisions.

12. Privacy

We collect and process personal data necessary to operate the Service, including your name, email address, and payment information. Payment processing is handled by Stripe; we do not store credit card numbers. We do not sell your personal information to third parties. Account data is retained for 90 days after cancellation, then permanently deleted.

13. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated by email to active subscribers at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in the State of Michigan.
